What is Whiplash?

Whiplash happens when your head is thrown forward and back suddenly, usually in a rear-end collision. The rapid movement strains the muscles, tendons, and ligaments in your neck. Symptoms include neck pain and stiffness, headaches, shoulder pain, reduced range of movement, and sometimes dizziness or blurred vision.

Symptoms often do not appear until 24 to 48 hours after the accident. Some people assume they are fine and do not see a doctor, which can make claiming more difficult later. Always get checked out, even if you feel alright at the scene.

How Much Is Whiplash Worth?

Whiplash compensation in Scotland is based on the severity of your injury and how long it takes to recover. As a rough guide: a minor whiplash that resolves within three months is typically worth £500 to £2,500. A moderate whiplash lasting 3 to 12 months is worth £2,500 to £5,000. A more severe case lasting over 12 months, or causing ongoing problems, can be worth £5,000 to £12,000 or more.

These figures are for the injury itself (called "general damages"). On top of that, you can claim for loss of earnings, travel to medical appointments, physiotherapy costs, and any other expenses caused by the injury. These are called "special damages" and are calculated separately based on your actual losses.

Scotland vs England: A Key Difference

In 2021, England and Wales introduced the Civil Liability Act which capped whiplash compensation for minor injuries and requires claims under £5,000 to go through the Official Injury Claim portal. Scotland is not affected by this legislation. Scots law treats whiplash the same as any other personal injury, with no artificial cap on compensation. This means whiplash claims in Scotland are often worth more than equivalent claims south of the border.

What Affects the Amount?

The main factors are the severity of your symptoms, how long your recovery takes, what the medical report says about your prognosis, whether you needed treatment (physiotherapy, medication), and whether the injury affected your ability to work or carry out daily activities.
