How Long Does an Accident Claim Take?

One of the first questions people ask us after an accident is "how long will this take?" The honest answer is that it depends on the type of claim and how straightforward the circumstances are. But we can give you a realistic idea of what to expect.
Vehicle Damage Claims
If liability is clear and the other driver's insurer accepts fault quickly, a straightforward vehicle damage claim can settle in 4 to 8 weeks. That covers getting your car repaired or, if it is a write-off, agreeing a market value settlement.
Where things slow down is when liability is disputed. If the other driver tells their insurer a different version of events, it can take several months for the insurers to reach a decision. Having good evidence from the scene (photos, witness details, a police report) makes a real difference to the speed of this process.
Credit Hire Claims
If your car is off the road and the accident was not your fault, you are entitled to a hire car while yours is being repaired. We arrange this for you at no upfront cost. The hire car claim itself settles separately and typically takes 3 to 6 months, sometimes longer. Insurers often challenge hire rates, so there can be negotiation involved. But that is our problem to deal with, not yours. You just drive the car and hand it back when yours is ready.
Personal Injury Claims
Injury claims take longer because they depend on your recovery. A minor soft tissue injury like whiplash, where you recover fully within a few months, might settle in 6 to 9 months. More serious injuries that need ongoing treatment or leave lasting effects can take 12 to 18 months, and complex cases can take longer still.
The reason for the wait is that your solicitor needs a full medical report, and that report should not be done until your treatment is finished (or your condition has stabilised). Settling too early means you risk accepting less than you are entitled to.
What Can Slow Things Down?
The most common delays we see are disputed liability (the other driver blames you), slow responses from the other insurer, incomplete medical evidence, and cases involving uninsured or untraced drivers, which go through the Motor Insurers' Bureau and take longer by default.
In Scotland, the general time limit for making a personal injury claim is three years from the date of the accident. For vehicle damage, it is five years. So there is no rush to accept a low offer just because you want it over with.
